1. In the privacy policy, the phrase "Store" used refers to the online store available in the domain www.berkovicz.pl. The phrase "BERKOVICZ" means the entity running the Store, i.e. TATRA LAB sp. z o.o. based in Kraków, entered into the Register of Entrepreneurs by the District Court for Kraków-Śródmieście, 11th Commercial Division of the National Court Register under KRS number 0000562654, share capital PLN 5,000.00, NIP 6793112581, REGON 361752690.

2. The privacy policy specifies how BERKOVICZ uses personal data of users who visit the Store, interact with it and use the services. It also informs you about your rights and how the law protects you.

3. It is important that each user reads this privacy policy so that they can fully consciously use the Store and BERKOVICZ services (including knowing how and why data is used).

DATA COLLECTED

6. BERKOVICZ collects various information about its customers and guests when they are provided to BERKOVICZ, when users use the Store or when BERKOVICZ obtains it from another source. The collected data can be assigned to the following categories:

1) Identification data

First name and last name. In case of contact via social media, also the username on these media.

2) Contact details

E-mail address, residential address and telephone number. In case of contact via social media - username in these media. In the case of a newsletter subscription, the Contact Data applies only to the provided e-mail address.

3) Financial data

Bank account number.

4) Tax data

Number NIP.

5) Technical data

Internet Protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.

6) Usage data

Information about how you use the website or services (behavior tracking).

7) Tracking data

Information that BERKOVICZ or others collect about users through the use of cookies and similar tracking technologies, such as web beacons, pixels and mobile device identifiers.

7. BERKOVICZ collects, shares and uses Aggregated Data (statistical or demographic data), which, however, does not constitute personal data. If this data is combined by BERKOVICZ with data enabling the identification of the user, the aggregated data is treated by BERKOVICZ as personal data.

8. BERKOVICZ does not collect sensitive data (special category data), including data revealing racial and ethnic origin, religious beliefs, data regarding sexual life and orientation, political opinions, information about health and diseases, and biometric and genetic data.

9. If a given user decides not to provide BERKOVICZ with any data, it may result in the inability to provide the services provided by BERKOVICZ. In cases where the law requires consent, it is always voluntary. However, BERKOVICZ does not rely solely on users' consent when processing data, but also on other grounds for data processing.

METHOD OF COLLECTING DATA

10. BERKOVICZ uses various methods of collecting personal data, i.e.:

1) Direct interactions

The user provides data directly to BERKOVICZ. The transfer takes place when placing an order, registering an account, contacting us by mail, contact form or telephone and contact via social media.

In this way, we collect Identification Data, Contact Data, Tax Data and Financial Data.

2) Automated activities

Data is collected automatically when interacting with BERKOVICZ (including via the website), through cookies and analytical tools.

In this way, we collect Technical Data, Usage Data and Tracking Data. We may also collect Aggregate Data.

We use cookies and analytical tools from third parties for automatic activities. A more detailed description of their activities can be found in the "Cookies" section below.

3) From third parties

Data is transferred by entities external to BERKOVICZ (including entities providing tracking, statistical services, etc., as well as entities providing login-related solutions), provided that these entities have a legal basis for the transfer. This basis is usually the user's consent. Entities providing login solutions provide tools that allow you to manage access to the transferred data.

In this way, we collect Technical Data, Usage Data and Tracking Data. We may also collect Financial Data (payment operators/payment gateways) and, when setting up an account, Identification Data and Contact Data.

Personal data may be obtained by BERKOVICZ via API located on the portals of BERKOVICZ business partners and entities providing services to BERKOVICZ.

HOW WE USE YOUR DATA

11. The method of using data by BERKOVICZ depends on the purpose for which the data was transferred or obtained:

1) When we perform an already concluded contract or want to conclude it.

As a rule, however, BERKOVICZ uses data to: (a) provide services provided electronically, and in the case of users with whom a contract has been concluded - also to perform this contract; (b) providing other services and handling orders placed in the Store; (c) handling inquiries, applications and orders; (d) marketing activities (marketing of own products); (e) analytical purposes and to improve the operation of websites and services provided by BERKOVICZ; (f) purposes of development, repair or testing of various functionalities;

RIGHTS OF PERSONS TO WHOM THE DATA CONCERN

13. The data subject (user) has the following rights:

1) Right of access, rectification, restriction, deletion or transfer

the data subject has the right to request from BERKOVICZ access to his or her personal data, rectification, deletion ("right to be forgotten") or restriction of processing and the right to object to the processing, and also has the right to transfer his or her data. Detailed conditions for exercising the above-mentioned rights are indicated in Art. 15-21 of the GDPR Regulations

2) The right to withdraw consent at any time

a person whose data is processed by BERKOVICZ on the basis of consent (pursuant to Article 6(1)(a) or Art. 9 section 2 letter a) of the GDPR), he has the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.

3) The right to lodge a complaint with the supervisory authority

the person whose data is processed by BERKOVICZ has the right to lodge a complaint with the supervisory authority in the manner and manner specified in the provisions of the GDPR Regulation and Polish law, in particular the Personal Data Protection Act. 4) Right to object

BERKOVICZ in such a case, the personal data may no longer be processed, unless it demonstrates the existence of compelling legitimate grounds for processing which override the interests, rights and freedoms of the data subject, or grounds for establishing, pursuing or defending legal claims.

5) Right to object to direct marketing

if personal data are processed for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning him or her for such marketing purposes, to the extent that the processing is related to such direct marketing

15. BERKOVICZ does not perform profiling

DATA TRANSFER

16. Data collected by BERKOVICZ is generally not transferred to third parties. However, BERKOVICZ may:

1) transfer data of persons who have concluded a sales contract with BERKOVICZ to courier companies and deliverers;

2) transfer the data of persons who have used BERKOVICZ services to entities supporting BERKOVICZ in the provision of services, such as payment processors or suppliers of analytical tools (e.g. Google Analitycs);

3) transfer data to law enforcement authorities, supervisory authorities, entities performing public tasks or others when the obligation to disclose data results from legal provisions.

The transfer of data must always take place on the basis of a legal provision or an appropriate contract (entrusting the processing of personal data).

17. Data may be transferred outside the European Economic Area, and BERKOVICZ ensures that appropriate security measures are provided. In particular, BERKOVICZ concludes appropriate contracts (standard contractual clauses) to secure the transferred personal data and transfers data to countries for which the European Commission has issued a decision confirming the level of protection.
